Welcome to HostMaji. These Terms of Service ("Terms") govern your use of the website located at hostmaji.in (the "Site") and the web hosting services provided by HostMaji ("Service"), an initiative of SoftMaji InfoTech Pvt. Ltd. Please read these Terms carefully.

1. Acceptance of Terms

By accessing the Site or using our Service, you accept and agree to be bound by these Terms. This agreement also incorporates by reference our Acceptable Use Policy (AUP), Privacy Policy, and Refund Policy. If you do not agree to all of these terms, you must not use our Service.

2. Description of Service

HostMaji provides web hosting services, including a free hosting plan (Pixy) and paid hosting plans (Neu, Algon). All services, especially the free Pixy plan, are provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, timely, or error-free. We reserve the right to modify or discontinue any part of the Service with or without notice.

3. User Obligations and Responsibilities

As a user of our Service, you agree to the following:

• You will provide accurate, current, and complete information during registration and will update it as necessary.
• You are solely responsible for all content you upload, post, or transmit through our Service.
• You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
• You agree to adhere strictly to our Acceptable Use Policy (AUP), which details prohibited content and activities.
• For our free hosting service, you agree to maintain only one account per individual. Creation of multiple free accounts is a violation of these Terms.

4. Payments, Fees, and Refunds

For paid plans (Neu and Algon), you agree to pay all applicable fees as described on our Site. For the free (Pixy) plan, you agree to the one-time, non-refundable ₹1 verification fee. All terms regarding refunds, money-back guarantees, and account credits are governed by our official Refund Policy.

5. Account Suspension and Termination

HostMaji reserves the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time. Termination will most often result from a violation of these Terms or our AUP. Termination due to a violation may be immediate and without prior notice. In such cases, you will not be eligible for a refund, and your account data may be permanently deleted.

6. Limitation of Liability

You expressly understand and agree that HostMaji shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or the inability to use the Service.

7. Indemnification

You agree to indemnify and hold HostMaji, its parent company SoftMaji InfoTech Private Limited, and their affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

8. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of India. You agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located in Lucknow, Uttar Pradesh, India.

9. Changes to Terms

HostMaji reserves the right to update and change these Terms of Service from time to time. Your continued use of the Service after any such changes shall constitute your consent to such changes.
